Why your business name is not a trademark (and why it matters)

Because both are handled by PACRA, founders often assume that registering a business name also protects it as a brand. It does not.

What a business name registration gives you

The right to trade under that name and open a bank account with it. It does not stop anyone else from using a similar name for similar goods.

What a trademark gives you

Exclusive rights to use the mark for the classes of goods and services you register, for ten years, renewable indefinitely. It lets you stop copycats, license your brand, and it becomes a real asset on your balance sheet.

Trademarks take several months to register, so the best time to file is before you spend money on marketing.
